The Ohio State Highway Patrol says that toxicology reports show the driver who caused a fatal crash in Marion County a month and a half ago was legally drunk.
On March 10, 2010, troopers from the Marion Patrol Post investigated a double fatality crash on State Route 4 between State Route 203 and Prospect-Upper Sandusky Road, in Marion County.
In the crash, Justin R. Shelton, age 29, of Richwood and Richard W. Baker, age 38, of Marion were both killed. The patrol says the preliminary investigation revealed that Shelton drove left of center striking Baker.
Toxicology reports have been received for both drivers. There were no signs of alcohol or illegal substances in Richard Baker’s system.
The results for Justin Shelton revealed a blood alcohol content of 0.213, with no signs of an illegal substance present. The legal blood alcohol level is 0.08.
“The toxicology results and circumstances surrounding this crash are tragic and devastating for both families involved” said Lt. Chuck Jones, Marion Post Commander.
